Milo Terms of Service

These terms are an agreement between you and Melvin Zaid, an individual based in California, United States ("we," "us," or "our"), for the Milo app and related services. Contact melzoogle@gmail.com. By accepting these terms or using Milo after they have been made available to you, you agree to them. If you do not agree, do not use Milo. The Privacy Policy explains our data practices; it does not replace any separate consent required by law.
These terms apply to Milo. Earlier Peach features remain described in the Peach service terms. This update does not retroactively treat a prior Peach acknowledgment as acceptance of materially different Milo terms.
1. Eligibility and your account
You must be at least 13 years old to use Milo. Milo is not intended for children under 13, and we do not offer a parental-consent option for them. If you are under 18, or under the age of majority where you live, you may use Milo only with the permission of a parent or legal guardian, and you should review these terms with them. A parent or guardian with a question or concern about a teen’s use of Milo can contact us at melzoogle@gmail.com. Provide accurate information, including age information. Do not misrepresent your age or use Milo on behalf of a child under 13.
Keep access credentials secure, use only an account you are entitled to use, and tell us if you suspect unauthorized access. You are responsible for activity you authorize. A guest account may store data on our servers but may not be recoverable if you lose its local access. Use available account-linking controls for recovery, and save information important to you.
2. What Milo is and its limits
Milo is an AI system, not a person. Its character, personality, stories, adventures, rewards, and expressions are part of a fictional experience. Replies, summaries, memories and journal reflections are generated and can be inaccurate, incomplete, biased, or unsuitable. They can misinterpret an image, remember incorrectly, or omit context. Check important information and use your own judgment.
Milo supports conversation, reflection, everyday activities, and recreation. It does not provide medical care, therapy, diagnosis, treatment, legal or financial advice, or a professional relationship. Mood charts, personality traits, streaks and progress scores are app features, not clinical measurements or guarantees about you or another person. Do not delay professional help because of a Milo response.
Milo is not an emergency or crisis service and does not provide real-time human monitoring or contact emergency services for you. If you are in immediate danger, contact local emergency services. See Safety and immediate-support resources. Automated safeguards and support reports can miss a concern and cannot guarantee an immediate response. Take a break whenever using the app feels unhelpful.
3. Your content and generated output
You retain your rights in messages, images and other material you submit. You must have the rights and permissions needed to provide it, including an appropriate lawful basis for information about others. Do not submit stolen, unlawfully obtained, or confidential material you are not entitled to share.
You give us a non-exclusive, worldwide, royalty-free license to host, copy, process, transmit and adapt your content only as reasonably needed to provide requested features, operate and secure Milo, address your requests, and comply with law, consistently with the Privacy Policy. We may authorize service providers to do this for us. This license lasts only as long as those purposes and permitted retention require; it is not permission to publish your private chats as advertising or testimonials.
You may use generated output for lawful purposes subject to others’ rights and these terms. To the extent we hold transferable rights in output generated for you, we assign those rights to you, excluding our pre-existing software, character artwork, branding and other service materials. Output may be similar across users, and we do not guarantee that it is unique, copyrightable, or free of third-party rights. Do not falsely represent generated output as a verified professional opinion.
4. Acceptable use and sharing
Do not use Milo to threaten, harass, stalk, exploit minors, distribute unlawful sexual content, invade privacy, impersonate others deceptively, commit fraud, infringe intellectual property, or break the law. Do not attempt unauthorized access, distribute malware, overload the service, evade safety or usage limits, or manipulate rewards and purchases.
Friend, invite and Together features are optional. Send invitations only to appropriate recipients; do not spam or pressure others. Shared goal titles and progress can be visible to the other participant. Use available remove/block controls or report misuse. Do not include private information in a shared goal that the other person should not see.
For a content or rights complaint, email us with enough detail to locate the issue and explain your concern. We may review, restrict, or remove content or access where reasonably necessary to address violations, safety, or law. We do not promise to review every message or report in real time.
5. Memberships, trials, and billing
Some features are free and others require a subscription or purchase. Before you confirm a purchase, the store purchase flow shows the price, billing period, trial or introductory terms, and applicable offer. Prices and availability can vary by region and eligibility. The offer you confirm controls; these terms do not promise a particular trial, price, or unlimited usage.
Subscriptions renew automatically unless cancelled under the store’s rules before renewal. An eligible free trial converts to the paid subscription shown at purchase unless cancelled in time. For an Apple free or discounted trial, cancel at least 24 hours before it ends to avoid renewal charges. Apple may end trial access immediately on cancellation. See Apple’s cancellation instructions.
Apple processes App Store purchases. Manage or cancel at Apple Subscriptions or in your device’s subscription settings. Use Restore purchases in Milo for an eligible prior purchase. A support email, signing out, deleting Milo, or deleting your account does not cancel an Apple subscription.
Refund eligibility is governed by applicable law and the store’s policies. Request an App Store refund through Apple’s purchase support. We do not exclude refunds or other remedies you are entitled to by law. Cancellation usually stops future renewal rather than refunding the current paid period. Price changes require the notice and consent required by the store and applicable law.
Plans may include feature or usage allowances shown in the app. Security, abuse-prevention and reasonable technical limits still apply. We will give required notice of material changes to paid benefits and honor applicable remedies for unavailable paid services.
6. Virtual currency, items, and progress
Shells, glow, character traits, streaks, gifts, room decorations, clothing and similar items are digital features for use within Milo. They are not money, investments, property outside the service, or a promise of a real-world prize. They cannot be redeemed for cash or traded outside features we expressly provide.
You receive a limited personal license to use virtual items as the service permits. Earning or spending virtual currency does not transfer ownership of Milo artwork or software. We may adjust activities, catalogs and reward rules, correct errors or fraudulent balances, and change features for reasonable operational reasons. We will respect any purchased entitlement and nonwaivable consumer rights. Deleting an account may remove its progress and virtual items. Separate promotions, if offered, have their own stated rules.
7. Our software and third-party services
We and our licensors retain rights in Milo’s software, design, characters, artwork and branding. Subject to these terms, you may use the service for personal, non-commercial purposes and install the app on devices you own or control under the applicable store rules. You may not resell the service, remove ownership notices, or copy or reverse engineer protected software except where applicable law or an open-source license permits it. This does not restrict your lawful use of your own content or output as described above.
External links and services have their own terms. We are responsible for our service as required by law, but do not control third-party sites you choose to visit. You are responsible for your device and network charges.
For an App Store download, Apple’s standard Licensed Application End User License Agreement governs the app license where applicable. These service terms are between you and us, not Apple. Apple does not provide Milo’s service or support. Applicable Apple usage rules, warranties and mandatory consumer rights continue to apply.
8. Availability, account closure, and changes
We may update, maintain, suspend or discontinue features, or restrict an account for a material violation, fraud, safety, security, legal requirements, or inability to operate the service. We will act reasonably and provide notice and an opportunity to address the issue when appropriate, except where doing so would create a risk or be unlawful. You may contact us to contest an account decision. Statutory refund and other consumer rights remain available.
You may stop using Milo at any time. Use Settings and the available data/account controls to request export, correction or deletion, or contact us if you cannot sign in. The Privacy Policy explains retention, provider cleanup and backup limits. Save any information you want before closing your account and separately cancel any subscription.
9. Warranties and responsibility
To the extent permitted by applicable law, Milo is provided “as is” and “as available,” without implied warranties of merchantability, fitness for a particular purpose or non-infringement. We do not promise uninterrupted access, error-free output, perfect memory, or any particular personal outcome.
To the extent permitted by law, we are not liable for indirect, consequential, special or punitive losses arising from the service, and our total liability for claims arising from the service or these terms is limited to the greater of US$100 or the amount you paid for Milo in the 12 months before the event giving rise to the claim.
These limits do not apply where prohibited by law. They do not exclude liability for fraud, intentional misconduct, gross negligence, death or personal injury caused by negligence, or any other liability that cannot lawfully be limited. Nothing removes mandatory consumer guarantees, statutory privacy rights, or remedies available under applicable law. You remain responsible for your own unlawful conduct; these terms do not make you responsible for our unlawful conduct.
10. Disputes and general terms
California law governs, except that mandatory protections of the law where you live continue to apply. Please contact us first if there is a problem so we can try to resolve it. Doing so is not a condition of exercising a legal right. These terms do not require binding arbitration or waive class-action or jury-trial rights. Disputes may be brought in a court with lawful jurisdiction, including any forum available under mandatory consumer law.
These terms and applicable purchase terms form the agreement for Milo. If a provision is unenforceable, the remaining provisions continue to apply. A failure to enforce a provision is not a waiver. We may transfer the service and associated obligations to a successor, subject to applicable law and the Privacy Policy, without reducing your mandatory rights.
We will post changes with an updated date and provide appropriate advance notice of material changes. Changes apply prospectively, and we will obtain renewed acceptance where required. If you do not agree, stop using Milo and use available cancellation and data controls. Required account, security and legal notices may be delivered through the service or your supplied contact information.
